Lance Armstrong retires from cycling for second time


Seven-time Tour de France winner Lance Armstrong has announced he is to retire from cycling for a second time.

The 38-year-old American quit the sport in 2005 before returning last year but he announced last month that 2010 would be the last time he rode the Tour.reported by A PAKISTAN TIMES

Armstrong finished 40 minutes behind winner Alberto Contador in 23rd place.

"This race has been good to me but I can't lie - I'm ready to retire part two," said Armstrong, who crashed on a number of occasions during the race.

S Korea-US military exercise begins in the Sea of Japan


The US and South Korea have begun a major military exercise in the Sea of Japan, despite threats of retaliation from North Korea.
The navy and air force manoeuvres involve 20 ships, 200 planes and 8,000 US and South Korean personnel.

Washington and Seoul say they want to send a clear signal to the North following the sinking of a South Korean warship in March.

An international investigation said a North Korean torpedo sank the ship.
However, the claim has been angrily denied by Pyongyang.

Two were rushed to a local hospital where they are being provided medical aid.

According to details, Anwar Kamal along driver Naseem was on his way to Hyderabad on Geo’s van after covering a news event relating to Dadu-Manchar Lake, when unknown gunmen on motorcycle opened indiscriminate fire at van.

The ambush took place in front of GOR police station, a woman police station, but the assailants could not be identified who, all of a sudden, succeeded to flee the crime scene, sources said.

Anwar Kamal received a bullet on his left shoulder, hospital sources confirmed to media.

DIG Hyderabad Fayyaz Laghari said security at all the city’s entrance and exit points has been beefed up.

QUETTA: The death toll in QUETTA: The death toll in flash floods unleashed by torrential rains in Balochistan rose to 60 on Saturday, A Pakistan times reported.

Ten more people died in the province’s Lehri and Tulli areas.

Thousands of people were rendered homeless in Barkhan, Kohlu and Sibi and aid and rescue work was affected because of long distances and damaged roads.

Train services from Balochistan to other parts of the country remained suspended as the flood damaged the railway track on five points in Sibi district’s Bakhtiarabad area.

Over five dozen villages were also submerged in Nasirabad district and Bakhtiarabad.

Hundreds of dead penguins wash ashore in Brazil

SAO PAULO — Hundreds of penguins that apparently starved to death are washing up on the beaches of Brazil, worrying scientists who are still investigating what's causing them to die.

About 500 of the black-and-white birds have been found just in the last 10 days on Peruibe, Praia Grande and Itanhaem beaches in Sao Paulo state, said Thiago do Nascimento, a biologist at the Peruibe Aquarium.

Most were Magellan penguins migrating north from Argentina, Chile and the Falkland Islands in search of food in warmer waters.reported by A PAKISTAN TIMES

Many are not finding it: Autopsies done on several birds revealed their stomachs were entirely empty — indicating they likely starved to death, Nascimento said.

Scientists are investigating whether strong currents and colder-than-normal waters have hurt populations of the species that make up the penguins' diet, or whether human activity may be playing a role.

"Overfishing may have made the fish and squid scarcer," Nascimento said.

Nascimento said it's common for penguins to swim north this time of year. Inevitably, some get lost along the way or die from hunger or exhaustion, and end up on the Brazilian coast far from home.

But not in such numbers — Nascimento said about 100 to 150 live penguins show up on the beach in an average year, and only 10 or so are dead.

"What worries us this year," he said, "is the absurdly high number of penguins that have appeared dead in a short period of time."

ST. PAUL, Minn. -- A 12-year-old girl used Facebook and an internet-enabled iPod to report a sexual assault by her mother's ex-boyfriend.

According to a criminal complaint, Cesmat entered the girl's room and tried to pull off her pants.

30 dead in rain related incidents

QUETTA: Heavy rain hit parts of Balochistan as flood in Hanna Lake in district Barkhan of Balochistan killed at least 30 people, Reported By A Pakistan Times

Deputy Commissioner Barkhan said floods from Hannan Lake swept away 50 people in Barkhan. Bodies of thirty dead have been recovered whereas rescue and search work continued in flood-hit area.

Road links between Barkhan and Kohlu have been cut off as the downpours washed away Nardwala Bridge. Deputy Commissioner Kohlu Nasrullah Rind said emergency has been declared in Kohlu and affectees are being shifted to safer places.

Meanwhile, Commissioner Sibbi Division Qamar Masood told Geo News that more than 800 people have been trapped in floodwaters. National Disaster Management Authority has been requested to send boats to rescue marooned people whereas four helicopters of Pakistan Army have also been called to take part in rescue operation.

Kingston man arraigned in third child-rape case



A Kingston man awaiting trial in two child-rape cases was arraigned Wednesday on charges of raping a third child on hundreds of occasions earlier this decade.

Brockton Superior Court Judge Joseph Walker III ordered Joseph H. Gardner held on $1.5 million bail with surety or $150,000 cash bail.reported by A PAKISTAN TIMES

Gardner, 27, was already being held without bail after pleading innocent Dec. 14 to raping a 3-year-old girl when she was staying overnight at his apartment with her mother.

At the time of that alleged offense, Gardner was out on bail after pleading innocent three months earlier to breaking into a Kingston home and raping a 5-year-old girl.

Plymouth County prosecutors say publicity from those two cases prompted the victim in the latest case to come forward.

Gardner is accused of raping the child on 300 to 400 occasions from 1999 to 2002. The girl reportedly told a counselor about the alleged abuse.

Gardner was indicted by a grand jury July 2 and faces one count of forcible child rape. He faces four additional child-rape counts in juvenile court for encounters he allegedly had with the child while he was still a juvenile.

An arraignment date has not yet been set in juvenile court. Prosecutors will argue to have the charges transferred to Superior Court.

Gardner is due back in Brockton Superior Court on Aug. 23 for a pre-trial conference.

An emergency medical technician for the Fire Department was arrested in a string of armed sexual assaults dating to 2001, including an attack on an 11-year-old girl July 11 this year, the police said Wednesday.REPORTED BY A PAKISTAN TIMES

The technician, Angus Pascall, 33, was accused of assaulting five women and girls between ages 11 and 22 in Brooklyn. He was captured on Tuesday after the latest victim copied down the license plate number of a car that she was forced into at gunpoint.

“That’s how this case was broken,” Police Commissioner Raymond W. Kelly said.

The woman, 20, was walking in the area of Canarsie on Monday afternoon when the suspect forced her into his car and raped her, the police said. He pushed her out of the vehicle and took off after the attack.

Fatherhood I: The Health Care Bit


Friday will be the girl’s first birthday, and in honor of one year as a parent I thought that I would toss together a few things I wrote on the topic (some from way back) and try to make a series of it. The first installment has to do with health care; the wife’s pregnancy was the first time that I had to deal at length with America’s health care bureaucracy. We also had to deal with the fact that my wife changed jobs shortly before the birth of the girl’s, meaning that we needed to shift between health care providers. This post is more about health care than fatherhood per se, but the experience of having kids brought me to a series of revelations about our health care system.reported by A PAKISTAN TIMES

So, last June I was a more or less happy human being with health care supplied by the University of Kentucky. We knew that my wife would soon leave her job, and we knew that pregnancy often involves a variety of health complications, so I decided to change from the cheap-but-adequate plan to the expensive-but-a-good-idea-if-you-might-get-sick plan. I discovered in the process of making this change that, because of a computer error, I’d actually been uninsured for about a year. Fortunately, I failed to get sick. In any case, I filled out the form and added Davida to the plan. When the little dependents arrived, I added them to the plan. Shortly after the LIFE CHANGING EVENT, we moved to Baltimore for the wife’s new job. The insurance plan offered by the University of Maryland was marginally better than the long distance plan offered by UK, so we switched the wife and kids to UM, while I stayed at UK. This required numerous additional forms. In January, we moved back to Ohio, and switched back to the UK plan, incurring reams of additional paperwork. Finally, in May we arrived at the “Open Enrollment” period at UK, in which I was able to change from the super-expensive plan back to the reasonably-priced plan.

Now, all of this sounds reasonably easy and straightforward; however, anyone who’s ever actually dealt with the multiple bureaucracies that make up the US health care system understand that the story could never be so simple. Every change involved negotiation with at least two, and often three, bureaucracies. The first interactions with UK were difficult, but went very well once someone at UK HR took an interest in our case and effectively became an advocate. This person (who deserves nothing but our eternal thanks) really went the extra-mile, giving out her office phone number so that we could have pharmacists call her in order to find out how much our prescriptions should cost. Had we not been so fortunate in finding someone interested in helping us out, we might have been in real trouble.

Jury Rejects Impotence Defense In Pa. Rape Case


EASTON, Pa. (AP) ― An eastern Pennsylvania jury has convicted a man of assaulting a child three years ago, rejecting his defense that he could not have committed the crime because medications he was taking caused erectile dysfunction.Reported By A Pakistan Times

Jurors in Northampton County Court deliberated for three hours Friday before convicting 50-year-old Russell Wallery of Moore Township of rape of a child, involuntary deviate sexual intercourse, and corruption of minors.

Prosecutors said he attacked a 10-year-old girl, who is mildly mentally disabled, from July 2007 to January 2008. Wallery testified that he has been impotent since 2006 due to heart problems and diabetes. But prosecutors said the girl would be incapable of maintaining her story so consistently if it was not the truth.

Wallery will be sentenced Sept. 13. Earlier, he pleaded guilty and later pleaded no contest in the case, but withdrew both pleas.

On eve of trial, Seattle serial rapist pleads guilty


On the eve of trial, a serial rapist accused in a string of sex assaults against Seattle homeless women has pleaded guilty as charged.Reported By A Pakistan Times

Entering a plea late Wednesday, Reginald "Tex" Breaux admitted to raping two women and attempting to rape a third during a months-long series of attacks in 2008.

Breaux, 52, was apprehended in January 2009 after eyewitnesses to the violent, bloody attacks and DNA recovered at the scenes enabled Seattle police to identify him as the assailant. Had he not pleaded guilty, opening statements in the case were expected to begin Thursday morning in King County Superior Court.

Writing the court, Senior Deputy Prosecutor Julie Kays noted that, though spread across four months and around the industrial area south of Seattle's downtown, the offenses committed by Breaux were "remarkably similar."

"Each victim was homeless and under the influence of either drugs or alcohol," Kays told the court. "Each woman resisted the defendant's initial attack but stopped resisting once the defendant became more violent.

"Each woman immediately reported the sexual assault to a stranger who helped them."

Marlborough man misses trial date in rape case


MARLBOROUGH —

A Marlborough man charged with rape has missed a scheduled superior court date, the Middlesex District Attorney's office said yesterday.Reported by A Pakistan Times

Lucas Aguiar was slated to begin a jury trial in Middlesex Superior Court on Tuesday, according to court records. He was arraigned in superior court last July.

Police said the parents of a 14-year-old girl reported that Aguiar raped her in March 2009. Police charged Aguiar, 23 at the time, with rape about one week later.

Aguiar, of 158-2 Boston Post Road East, is charged with seven counts of statutory rape of a child and violating an abuse prevention order.

Lubbock police determined the reported rape case of a Lubbock teen over the weekend was unfounded.

Lt. Neal Barron said detectives closed the case, but wouldn’t release any details about how authorities came to the conclusion that it was unfounded.

As the newscasters struggle to suppress smirks, they explain that these are the latest entries in an ever expanding list that could see parliamentarians not just lose their seats but also possibly face jail time. In June, the Supreme Court and a parliamentary committee asked the country's 1,170 parliamentarians to prove that they are bona fide university graduates. Strangely enough, the court is asking the legislators to comply with a law that is no longer on the books, struck down as unfair just before its unpopular author, former President General Pervez Musharraf, left office upon the election of a new government in 2008. (The law was inequitable, said the country's Attorney General at the time, because with adult literacy at only 55%, nearly half the country would be ineligible to run for office.) Nevertheless, the court wants to know if the current lawmakers, who ran for office while the law was in effect, abided by its rules. Pakistan knows where Osama is hiding: Clinton


Elements in the Pakistan Government, in particular its intelligence establishment, know where Osama bin Laden, the al-Qaeda leader, is hiding inside the country, the US Secretary of State Hillary Clinton has said, declaring America will not be satisfied till it gets the most wanted fugitive of the world.

"I don't want to put a proximity or timeline on it (getting bin Laden). As I've said, we have gotten closer because we have been able to kill a number of their trainers, their operational people, their financiers," Clinton said in an interview to the Fox News channel in Islamabad.

She said the US and international forces were getting closer to the fugitive. "But I won't be satisfied until we get it done," she said.

The Secretary of State said she believes that some elements in the Pakistan Government knows where Osama is hiding.

Rape case doctor sacked


KARACHI: The Sindh health department has sacked Dr Abdul Jabbar Memon, a medico-legal officer at Jinnah hospital, who has been accused of raping a trainee nurse on Tuesday.

The nurse was treated for head injuries after jumping from the first floor flat in the doctors’ colony allegedly to escape Memon. She has regained consciousness after surgery and according to JPMC’s Dr Seemin Jamali, is out of danger and can now recognise people. “She is responding to questions,” she told the media.

The case’s investigation officer, Rao Mubashir, said they had yet to record her statement. On Saturday, the police surgeon and special secretary for public health Captain Abdul Majid visited the nurse but were unable to get a statement either. Doctors said she may be able to give one in two days.

The nurse has blackeyes and can barely see from her swollen right eye. She is being kept in the surgical ICU at Jinnah hospital but visitors are limited. “Let me go home otherwise they will kill me,” she is reported to be repeatedly saying. Her mother keeps reassuring her that she is safe. “Who are they?” the nurse keeps asking when she sees paramedical staff standing around her. A doctor on duty said that the nurse is drifting in and out of consciousness. Professor Sattar Hashim, the neurosurgeon who operated on the nurse, told The Express Tribune that she was still disoriented and it would take about four to five days for her to give any statement.

Several political leaders and members of the government have visited her and ensured their photographs were taken.

The nurse’s parents hail from the Punjab but were living in Korangi No. 1. Her mother told The Express Tribune that someone had been calling the nurse with threats about one week back but she did not give her family any names. She had stopped going to work at the hospital. “She decided to return later,” her mother said. “She told us that her madam had assured her [she would be safe].” The day she went back to nursing school, the incident occured.

Thailand shakes its hips like Bollywood


Bangkok: Thailand may be thousands of kilometres from India, but Bollywood cinema is making an impact here.Reported by A Pakistan Times

There is a legion of Indian film fans in the Thai capital and now hundreds of Thais are training to master the rhythmic, alluring, and acrobatic art of Bollywood dancing.

Many Thais don't understand all of the Hindi lyrics, but that doesn't stop them from dancing like professionals.

"We don't know what each Indian song means, so the master will explain the meaning every time," says Siriwan Wangvilai, who took up Bollywood dancing just a year and half ago. "He tells us this sentence means so and so. Dancing is not just dancing, but we get a feeling of the dance too and we can put emotion into it. And it helps to burn fat too, so dancing helps to get your body in shape."

Bollywood dance instructor Nareen Nyathi grew up in the Indian city of Hyderabad. Four years ago he began teaching Bollywood dance classes in Bangkok.

He now leads three or four classes a week, and he has as many as 500 Thai students.

"Basically, they love Indian culture, so they see many Bollywood movies, and they love to listen to Bollywood music all the time," says Nareen. "And when they come here, when they listen to Bollywood songs, they may not understand the language, but they understand the language of music. It's really good. And they get involved automatically in that and they go with us. When we teach, they go with us like anything. If anybody sees them, they will feel that they are Indians."

As many as 85,000 Indians live in Thailand. Most are Sikh and live in Bangkok's historic Indian district known as Pahurat.

But most Bollywood dance students are ethnic Thais who've fallen in love with Indian cinema.

India has become the largest film producing nation in the world and the availability of elephants, lush jungle, exotic beaches, professional crews, and relatively low production costs, has brought many Bollywood film sets to Thailand in recent years.

In 2003, 31 Indian films were shot in Thailand.

The number rose to 104 in 2009, according to Film Journal International.

In 2009, Thailand was given the top locations award at the Locations World Exhibition and Conference held in Mumbai.

Thailand hosted Bollywood's annual film awards, known as the International Indian Film Academy awards in 2008. The gala event was held at Bangkok's posh Siam Paragon Theater, and was a hit with thousands of Bollywood film fans in Thailand.

Rujapa Chiddrattantham has trained in Bollywood dance for over two years and says she it helped her lose more than 10 kilogrammes (1 stone 8 pounds).

"The reason I like Bollywood dancing is first because of movies," says Rujapa. "I've seen many Indian movies. I also like the way they dance, the way they use body language. I like it a lot. Their way of dancing is strange and looks like fun. It doesn't matter if the song is slow or fast, we are able to, like for slow songs, we are able to dance fast steps. Even when the music is slow, we can dance with very quick movements."

They have even roped in John Abraham, Lara Dutta and Neha Dhupia and developed games based on the movies produced by UTV themselves. Mr Siddharth Roy Kapur, Chief Executive Officer of UTV Motion Pictures, says, “Most production houses are sitting on a goldmine of content. We have already put our team in place to identify how we can use our content in a suitable and innovative way for mobile users”.

DNA check solves rape case


After giving a DNA sample at a police checkpoint an 18-year-old was charged with a historic rape said to have been committed when he was 15.Reported By A Pakistan Times

Napier labourer Jacob Olaf Nelson was charged with rape, unlawful sexual connection, indecent assault and performing an indecent act on a 14-year-old girl after DNA evidence given matched that taken from a semen sample in 2007.

He pleaded guilty in Napier District Court and was sentenced to four years in prison.

Crown prosecutor Fiona Cleary said the aggravating factors were the age of the girl and her vulnerability because of extreme intoxication and recommended a starting point of about eight years.

Nelson's lawyer Tony Snell said his client had been unaware of the charges, otherwise he would not have consented to providing a DNA sample and described the offending as "opportunistic".

The police summary of facts said the two had been drinking at a 21st birthday party, where the girl become extremely intoxicated.

Noting her intoxication, two females then took her to an address where Nelson was also welcome and put her to bed.

Nelson followed the girls home and when the victim was alone entered the room and raped her.

When she asked him who he was he said nothing and hid his head with a blanket.

Mr Snell said the "reality of what happened here is there were two people who got very drunk. Mr Nelson has no recollection of this offending".

"Since the DNA swab was made and a hit on the database was made he has been completely co-operative with police - this is an episode that he did not know had occurred."

Judge Lindsay Moore said it was the community's responsibility to look after their young people who acted before thinking when drunk. "The simple reality was that she was too drunk to offer proficient resistance or kick up enough fuss," he said. "This is a young fella who knowing this young girl had, in effect been taken for her own protection, to a house he was also welcome in quite deliberately used the fact he could get into the house without drawing attention to himself to exploit her sexually."

Addressing Nelson, he said: "She was your target. There was nothing random about it."

He noted that many in the gallery could have looked after the complainant and victim better, saying: "Putting the blame on you does not reflect the role of the community to protect its young people."

But Mr. Moody, now based in Brooklyn, is calling his new work, "The Four Fingers of Death," a sequel of sorts. Never mind that the novel, out next week, is set 15 years in the future and involves a mission to Mars; Mr. Moody says the inspiration lies in a period in the early 1970s when he and his siblings watched horror movies on TV. The book centers on a man named Montese Crandall, who is writing a novelization of the 1963 film "The Crawling Hand"—a Moody clan favorite.

"For us, these kinds of B-horror films were a family ritual in the time when we trying to get through my parents' divorce," Mr. Moody says.

First Look: The Town Trailer


Ben Affleck directs and stars in The Town, a crime drama based on the book Prince of Thieves by Chuck Hogan and set to hit theaters on September 10th. Warner Bros just released the first trailer and it's pretty intense, although I'm not sure it needed the tagline: "From the acclaimed director of Gone Baby Gone." But other than that, the trailer does a decent job of building interest in the film which also stars Jeremy Renner (The Hurt Locker) and Jon Hamm (Mad Men). Check it out and see what you think:

Silibil N Brains, Fake ‘American’ Rappers Story



Have you ever heard of rappers Silibil N Brains? Well, me neither, but today their story has come to the light, thanks by NPRmusic.com.

It turns out that they are a couple of friends called Gavin Bain and Billy Boyd, who were aspiring to get a career as rappers. After trying so hard to impress the people in charge of auditions and talent scouts and failing (not because of their talent, but because of their accent), they finally decided to change their identities and use an alias.

But they even went as far as creating a story for their characters. And also claimed they were Americans that went to live to London, this made all the difference for the couple of friends:

“These lyrics were just the same when we did them again in American accents, There was nothing different, and all of a sudden, people were saying, ‘Oh, wow. They’re just as good as Eminem.’ But in the Scottish accent, they’re saying, ‘Oh, no. They don’t have any talent.’ ”

Sabar Kashour, a young man from East Jerusalem , was sentenced today (Monday) to 18 months in prison after having defrauded and thereby raped and committed indecent acts upon a Jewish young woman, who only yielded to him because she thought he was a Jew. Additionally, the judges – Deputy Presiding Justice Zvi Segal, Moshe Dror, and Yoram Noam required Kashour to pay the complainant financial compensation amounting to NIS 10,000.

The prosecution representative, Adv. Daniel Vittman, argued that Kashour had indeed carried out his plot without the use of force, but that he had dissipated her ability to object to his actions by means of the false representation about his personal situation – [claiming that he was] a Jewish bachelor interested in a significant romantic relationship. In this way he abused her desire for a deep emotional relationship, which was the only reason that she agreed to have sexual relations with him.

According to the indictment, to which Kashour (30) entered a guilty plea, he presented himself to a young woman whom he met in the center of Jerusalem in 2008 as a Jewish bachelor interested in a significant romantic relationship, despite the fact that he is married.

He invited her to accompany him to a building on Hillel Street. When they came to the top floor, Kashour undressed the young woman and had intercourse with her, with her consent, that had been fraudulently achieved, as stated above. After having carried out his scheme, he departed from the building and left her naked, on the top floor of that building.

Court hears three Kadavu rape cases


The Suva Magistrates Court held a special seating over the weekend for three separate rape cases that allegedly took place in Kadavu.Reported by A Pakistan times

A 37-year old lay preacher of Daku village, a 73 year-old grandfather of Vunisei village, and a 26-year old man of Joma village all of Kadavu appeared before chief magistrate Premila Rathuyanka.

All three were denied bail.

Police prosecutor Sergeant Leone Lautabui objected to bail for all three men citing the seriousness of the cases.

In the first case, the court heard that the 73 year old allegedly indecently assaulted a six year old girl in his house.

The second case involves a 37 year old lay preacher who is alleged to have assaulted his sister in law and attempted to rape her.

In the third case a 26-year old man is alleged to have raped a class seven and a class four student of Joma village in Kadavu.

No plea was taken and all three men will appear in court tomorrow.

After tickling the funny bones of their fans with Hera Pheri, Garam Masala and Bhool Bhulaiyaa, the hit pair of director Priyadarshan and actor Akshay Kumar is back for the sixth time with yet another light-hearted outing, Khatta Meetha, which releases Friday.Reported By A Pakistan Times

While their previous films were slapstick comedies, Khatta Meetha takes a dig at the corruption and bribery.

"Our country is said to be a growing superpower with the fastest growing economy, but we still do not have good roads because of corruption in our system. This film is a message to people involved in the system...," said Akshay.

Produced by Shree Ashtavinayak Cine Vision Ltd and distributed by DreamWorld Searchlight Pictures, Khatta Meetha is a remake of Priyadarshan's 1988 Malayalam film Vellanakalude Naadu. It will also launch southern actress Trisha in Bollywood.

The star cast of the film also includes Makrand Deshpande, Johnny Lever, Rajpal Yadav, Aroona Irani and Milind Gunaji.

Akshay's character in Khatta Meetha is modelled on R.K. Lakshman's iconic Common Man cartoon character.

The movie revolves around a struggling road construction contractor, Sachin Tichkule (Akshay), who dreams big but his dreams never come true as he doesn't have enough money to bribe the 'babus'. To make matters worse, the new municipal commissioner turns out to be his ex-girlfriend Ganpule Madam (Trisha), who now hates him.

"It's my first Hindi film and I can't expect to have everything that appeals to me. It's definitely not a film where I am singing and dancing around trees. But it's good enough for a launch and Priyan has projected me very well. Akshay's comedy would be the highlight of the film," Trisha had told IANS.

The movie has had its share of controversies too. Akshay found himself in the midst of a furore after he visited the ailing Laxman. Some believed it was a promotional tactic for his film. But Akshay later clarified saying he was invited by Laxman's family.

Khatta Meetha has also made headlines over a controversial song titled Bullshit, which takes potshots at corrupt politicians.

However, the actor said: "We are not taking names of any individual or political party in the track. We are just commenting about corruption."

Rape charge Russian pianist Pletnev returns to Thailand

Russian pianist Mikhail Pletnev, accused of raping a 14-year-old boy, has briefly appeared at a Thai court. Reported by A Pakistan Times

Mr Pletnev was ordered to return to the resort town of Pattaya every 12 days to renew his bail, set at $9,000 (£5,900).

Mr Pletnev, who conducts the Russian National Orchestra, is allowed to travel abroad as long as he continues to make his court appearances.

Speaking to reporters outside court, Mr Pletnev said: "I say again these allegations are not true."

"I have always stated that I will assist the police in every way I can with their enquiries into the allegations that have been made against me."

Mr Pletnev was charged with rape earlier this month. If found guilty he could face up to 20 years in prison.

He was not considered a flight risk because he is resident in Thailand and owns property there.

Mr Pletnev is an internationally famous musician - a virtuoso pianist, composer and conductor - and a friend of former Russian President Mikhail Gorbachev.

Police bail man arrested in festival rape probe

A 19-year-old man arrested in connection with a second rape allegation at the Latitude Festival was released on bail, police said.

The alleged incident on Friday night/Saturday morning was not connected with an investigation into an earlier attack on another woman at the music festival, according to Suffolk Police.

A spokesman said a 17-year-old girl reported she was raped in a tent at the site in Southwold, Suffolk.A Reported by A Pakistan Times

The arrested man was bailed to return to Lowestoft police station on September 2 pending further inquiries, the spokesman said.

Police said the alleged attack did not appear to be linked to an allegation of rape by a 19-year-old woman at the festival, which featured acts such as singer Sir Tom Jones and violinist Nigel Kennedy.

The woman, from Norwich, was allegedly raped by at least one man late on Thursday.

A police spokeswoman said the woman was attacked after losing her way when looking for a toilet at around 10pm, about two hours before Sir Tom performed.

She said the woman approached a group of three or four men to ask for directions and they offered to show her the way.

They walked for some distance before some of the group left and she was then grabbed and raped, possibly against a tree, by at least one of the men.

Police are searching for a man aged in his 20s with short dark curly hair and a cockney accent in connection with the alleged attack.

Man in rape case also charged with assault in connection with HIV status

Tumbwe, former minister with Potter’s House, claims sex was consensual; 2 other women say defendant didn’t reveal his status and gave them HIV
Nathaniel Tumbwe is on trial in Dallas for aggravated assault with a deadly weapon. The weapon is his penis and his bodily fluids are the bullets because he has AIDS, herpes and genital warts.

According to testimony in Tumbwe’s criminal trial, Tumbwe made repeated advances to Carolyn Hudson, which she refused. In October 2008, she reported to police that he raped her in her house. She said she invited him to her home twice to discuss religion and on that second visit he raped her.

Weeks later she learned he had AIDS.

The defense claimed that Hudson simply regrets having had a relationship with Tumbwe.Reported By A Pakistan Times

Hudson is a receptionist at Potters House, a megachurch in Southwest Dallas. Tumbwe refers to himself as a reverend who was affiliated with the church at the time.

Hudson has tested negative for HIV. Two other women who contracted the virus after unprotected sex with Tumbwe will testify at the punishment phase of the trial if he is convicted.

Ken Upton, staff attorney for Lambda Legal in Dallas, said that calling the penis a weapon is unusual.

He said that Lambda Legal has filed briefs in cases where police charged someone with assault when a person with HIV that was being arrested spit on the officer. Since that is not a method of transmission and spitting is not normally seen as assault, the courts dismissed the charges.

In a 2009 case in Michigan, a man with HIV arrested for assault was also charged with bioterrorism after biting his victim. Lambda Legal filed a brief in the matter.

“This charge leads to public misunderstanding of how HIV is transmitted, contributes to stigmatizing people with HIV and undermines important public health goals,” Lambda Legal attorneys wrote in their brief.
In June 2010, the bioterrorism charge was dismissed.

But Upton warned about having unprotected sex or not revealing one’s HIV status to a sexual partner.

“Knowingly having unprotected, nonconsensual sex puts it in a different category,” Upton said.

He said in Texas it would at least be a good argument for battery.

Why Dallas prosecutors would go for the assault with a deadly weapon charge, however, when rape has severe penalties, Upton said he could only speculate. He thought they might have added the charge in order to get a plea bargain. Once the case went to trail, he suggested it might have been to further bias the jury against the defendant or simply add charges.

Jamille Bradfield is the public information officer for the Dallas County district attorney’s office. She said she could not comment on the case because the trial is ongoing.

The charge has worked in North Texas before.

In 2009, a Frisco man was convicted of six counts of aggravated assault with a deadly weapon — his bodily fluids — because he was HIV positive. Ten women who seroconverted after having sex with him testified for the prosecution. The sex was apparently consensual. No rape was charged.

That case was the first in which DNA testing showed that the defendant was the source of the infection. He was sentenced to 45 years in prison.

In March, a Houston man was charged with having unprotected sex with a minor. The charges were upgraded to aggravated sexual assault when police learned that he was aware of his HIV positive status.

Enhancing the charges when HIV is involved is becoming more common according to The Center for HIV Law & Policy. They list about 60 current or recent cases across the country. Charges range from spitting and knowingly spreading infectious disease to assault with intent to kill.

The cases involving sex, rather than spitting or biting, all appear to involve heterosexuals.

The organization calls penalties for crimes involving persons with HIV “draconian,” with up to 25 years in prison even when no transmission occurred.

In the Tumbwe case, there was apparently no infection in the case of the rape victim. Hudson has not tested positive for HIV but is being told that she needs to retest once a year for 10 years.

Bret Camp, associate executive director for health and medical services at Resource Center Dallas, said that was ridiculous and unnecessary.

“Technology has advanced,” Camp said. “HIV RNA testing is now available at Nelson Tebedo Clinic through a partnership with Dallas County. It detects HIV in seven to 10 days after an exposure.”

He said for peace of mind, he’d recommend a follow-up at 60 days, but called even that medically unnecessary. He said he knows of no cases where someone suddenly tested positive years after exposure.

David Clohessy, national director of the Survivors Network of those Abused by Priests, has been following the Tumbwe trial and said the case is of particular interest because of the trust people place in other people involved in their church.

He said that prosecuting crimes involving churches are particularly difficult.

“Often people associated with a church are reluctant to speak up,” Clohessy said. “By cooperating with law enforcement, churchgoers are strengthening their congregations and making them healthier communities.”

And many churches are reluctant to discuss HIV prevention. By going public, Hudson may have helped open the discussion of several topics at the church including HIV testing and revealing status to partners as well as sexual abuse by church elders.

At press time, the trial was still in progress. Tumbwe faces 20 years in prison if convicted.

Motion Filed To Remove Judge From DA Rape Case

MARTINEZ, Calif. -- The defense attorney for Michael Gressett, a former Contra Costa County prosecutor charged with raping and sodomizing a junior colleague during a lunch break at his house in Martinez in 2008, has filed a motion to recuse the judge from the case.Reported By A Pakistan Times

In his motion, Gressett's attorney, Michael Kotin, argued that Judge Carlos Ynostroza, a retired Alameda County judge, might not be able to be impartial towards Gressett because of his relationship to several witnesses in the case.

Ynostroza's daughter is a deputy district attorney in Alameda County, where Nancy O'Malley is the head district attorney.

Nancy O'Malley's brother, Dan O'Malley, is a candidate for district attorney in Contra Costa County and his wife, Mary Ann O'Malley, is the presiding judge in Contra Costa County. They are also both potential witnesses in the case.

The defense is arguing that it would be improper for Ynostroza to rule over any issues involving anyone in the O'Malley family because his daughter works for Nancy O'Malley.

The defense has subpoenaed Dan and Nancy O'Malley's phone records because they believe they could provide evidence proving that Gressett is innocent of the charges against him.

According to the motion, Ynostroza also has a second conflict of interest involving the alleged victim's father, who worked in the Alameda County Public Defender's office while Ynostroza was on the bench in Alameda County.

The alleged victim's father will also be called as a witness in the case.

When the case against Gressett was originally filed, the presiding judge at the time ruled that all judicial officers in Contra Costa County should be recused from the case.

Ynostroza, however, later allegedly sought advice from Mary Ann O'Malley about the case, which the defense has argued is improper.

The motion further alleges that Ynostroza frequently sits as a judicial officer in Contra Costa County and was doing so at the time the case against Gressett was filed, which would also go against the original judge's ruling to disqualify all judicial officers in the county.

Kotin also argued that Ynostroza improperly advocated against Gressett's motion to have his former attorney Daniel Russo appointed to represent him in two memos written to the California Court of Appeal and the California Supreme Court.

Gressett has been indicted on four counts of forced sodomy, four counts of sexual penetration by force, two counts of forcible rape, one count of forced oral copulation, one count of false imprisonment and one count of criminal threats against the victim during a lunch break at his Martinez home on May 8, 2008.

The indictment also charges Gressett with numerous enhancements, including allegations that he used an ice pick and a handgun and tied or bound the alleged victim during the assault.

Rape case doctor sacked


KARACHI: The Sindh health department has sacked Dr Abdul Jabbar Memon, a medico-legal officer at Jinnah hospital, who has been accused of raping a trainee nurse on Tuesday.Reported by A Pakistan Times

The nurse was treated for head injuries after jumping from the first floor flat in the doctors’ colony allegedly to escape Memon. She has regained consciousness after surgery and according to JPMC’s Dr Seemin Jamali, is out of danger and can now recognise people. “She is responding to questions,” she told the media.

The case’s investigation officer, Rao Mubashir, said they had yet to record her statement. On Saturday, the police surgeon and special secretary for public health Captain Abdul Majid visited the nurse but were unable to get a statement either. Doctors said she may be able to give one in two days.

The nurse has blackeyes and can barely see from her swollen right eye. She is being kept in the surgical ICU at Jinnah hospital but visitors are limited. “Let me go home otherwise they will kill me,” she is reported to be repeatedly saying. Her mother keeps reassuring her that she is safe. “Who are they?” the nurse keeps asking when she sees paramedical staff standing around her. A doctor on duty said that the nurse is drifting in and out of consciousness. Professor Sattar Hashim, the neurosurgeon who operated on the nurse, told The Express Tribune that she was still disoriented and it would take about four to five days for her to give any statement.

Several political leaders and members of the government have visited her and ensured their photographs were taken.

The nurse’s parents hail from the Punjab but were living in Korangi No. 1. Her mother told The Express Tribune that someone had been calling the nurse with threats about one week back but she did not give her family any names. She had stopped going to work at the hospital. “She decided to return later,” her mother said. “She told us that her madam had assured her [she would be safe].” The day she went back to nursing school, the incident occured.

IO Mubashir and his team have some witnesses but are waiting for the nurse’s statement before they can proceed with the investigation. For his part, the MLO, Dr Jabbar, has denied any involvement. According to Mubashir, the case has become so high profile that intelligence personnel are holding their own investigation. “We have learnt that some people have also been picked up by the agencies,” he said. “But we are not sure who they are.”

Meanwhile, the nurses from outside Jinnah hospital have backed their colleagues. Protests were held in Lyari General Hospital, Abbasi Shaheed Hospital, Civil hospital and the Ojha Institute of Chest Diseases.

The Jinnah hospital administration has issued letters to all the residents of the hostel to be present in their rooms on July 19 so that action can be taken against illegal occupants.

Dr Memon had several run-ins with the authorities. He was suspended two months ago for failing to comply with orders and answer show-cause notices. There were 13 offences including a failure to appear in court, breaking the lock and illegally occupying flat No. 61, causing a disruption in the casualty department, failing to appear before the provincial mohtasib and tampering with medico-legal reports.

A South African beauty therapist who was allegedly raped while working on a cruise liner in the Caribbean has engaged a US law firm to fight her case.


Port Elizabeth-born Taryn, 30, who requested that her surname not be used, said she was forced to leave the industry after her ordeal aboard the liner owned by Royal Caribbean International.Reported by A Pakistan Times

This week she hired Lipcon, Margulies, Alsina & Winkelman, which specialises in maritime law and cases involving passengers and crew injured on ships worldwide.

Taryn said she was raped by a fellow South African, a fitness instructor, and sent home after reporting the incident.

"I believe they sent me home to hide the case and protect their reputation - they didn't care about my wellbeing.

"The easy part was to get over the physical rape, the hard part was, and still is, trying to convince myself that I did the right thing by reporting the incident, despite being made to feel like I was in the wrong, despite still feeling like no justice was done and despite having no one but my family and friends to support me emotionally."

Taryn said after she reported the matter, the cruise captain told her: "There are two stories, his and yours, but his sounds more believable, because you had been drinking."

She said she was advised to drop the matter or face an FBI investigation into the incident since the alleged rape had taken place on a US-registered vessel. After she decided to drop the matter, "I was given two hours to pack my bags and say goodbye."

Speaking from Miami, Florida, lawyer Charles Lipcon said he had handled several cases involving South Africans.

"Some crew members, especially the captains and other senior officials, have been blackmailing female cadets and crew members to have sex with them or face a miserable life at sea."
